Capitalized terms used but not defined herein shall have the meanings ascribed to them in the Terms of Service.
During a limited period of seventy-two (72) consecutive hours immediately following Customer’s initial purchase of any TestFit product(s), service(s), or subscription(s) using the self-service checkout functionality available on TestFit’s website (the “Initial Cancellation Period”), Customer may cancel such purchase (an “Initial Cancellation”) by sending to TestFit a clear and written Initial Cancellation request that must be both (1) sent from the Customer email address provided to TestFit during completion of the original transaction (the “Customer Email Address”), and (2) delivered to TestFit’s support email address (support@testfit.io) within the Initial Cancellation Period. TestFit will not process any Initial Cancellation request sent from any email address (or any alternative method of contact) other than the Customer Email Address on file.
Where Customer validly delivers an Initial Cancellation request during the Initial Cancellation Period, TestFit will revoke in full Customer’s access and usage rights (and all other associated rights and remedies) in respect of the cancelled TestFit product(s), service(s), or subscription(s), and Customer will receive a refund of any associated amounts already charged to the payment card used to complete the original transaction.
Where the Initial Cancellation Period has expired absent Customer’s valid delivery of an Initial Cancellation request, Customer may not cancel or terminate its original transaction (or receive any refunds in respect thereof) except to the extent otherwise expressly permitted by TestFit’s Terms of Service.
Customer’s right to effect an Initial Cancellation applies only to Customer’s initial purchase of TestFit product(s), service(s), or subscription(s), and not to any Renewal Terms in respect thereof. Cancellations or refunds are not available for Renewal Terms except to the extent otherwise expressly permitted by TestFit’s Terms of Service.
Customer’s right to effect an Initial Cancellation applies only to purchases completed solely via the self-service checkout functionality available on TestFit’s website (https://www.testfit.io). For the avoidance of doubt, the Initial Cancellation right described herein is not available in respect of any purchases executed via any agreements (or other means) extrinsic to such self-service checkout functionality.
