ADDITIONAL TERMS OF SERVICE FOR SELF-SERVICE CHECKOUT
These Additional Terms of Service for Self-Service Checkout (the “Self-ServiceTerms”) govern the relationship between TestFit and Customer with respect to any TestFit products and/or services that are purchased by Customer solely via the self-service checkout functionality available on TestFit’s website (the “Self-ServiceProducts”).
For the avoidance of doubt, (i) these Self-Service Terms do not apply to any TestFit product(s), service(s), and/or subscription(s) that are not Self-Service Products, and (ii) TestFit’s standard Terms of Servicev (the “Standard Terms”) apply to and govern Customer’s use of all Self-Service Products except to the extent that such Standard Terms expressly are modified by these Self-Service Terms.
Capitalized terms used but not defined herein shall have the meanings ascribed to them in the Standard Terms.
Monthly Subscription
The Order Term of each Order for any Self-Service Product shall be one (1) calendar month from the date upon which Customer completes the self-service checkout process; and the Renewal Term for such Order shall be one (1) calendar month from the expiration of the preceding Order Term or Renewal Term.
Notices of non-renewal must be delivered to TestFit via either (1) the “click-to-cancel” link provided, or (2) a clear and written request sent from the Customer email address provided to TestFit during completion of the original transaction (the “Customer Email Address”) to TestFit’s support email address (support@testfit.io). If Customer does not deliver notice of non-renewal at least two (2) business days prior to the expiration of the then-current Order Term or Renewal Term, then the Agreement will automatically renew, and all Fees and Other Charges assessed in respect of the resulting Renewal Term shall be non-refundable. If Customer delivers a notice of non-renewal fewer than two (2) business days prior to the commencement of a Renewal Term, such notice of non-renewal shall be effective as of the expiration of such Renewal Term.
For the avoidance of doubt, Customer’s notice of non-renewal shall not entitle Customer to any refunds, prorations of Fees and Other Charges, or credits for any then-current or prior Order Terms or Renewal Terms.
Payment of Fees and Other Charges
By completing the self-service checkout process and purchasing any Self-Service Product, Customer expressly authorizesTestFit and TestFit’s third-party payment processor(s) to automatically charge all applicable Fees, applicable taxes, and any other amounts payable under theAgreement (collectively, “Fees and Other Charges”) to the payment method(s) provided by Customer to TestFit – without further authorization from (or notice to) Customer – until the Agreement expires or is terminated according to its terms.
Customer represents and warrants that (i) Customer has the legal right to use such payment method(s), and (ii) Customer is solely responsible for any bank fees, interest charges, finance charges, over draft charges, and any other fees Customer incurs due to the charges billed by TestFit.
If TestFit is unable to charge Customer’s payment method(s) on file to collect any duly owed Fees and OtherCharges (or if Customer otherwise fails to pay any amounts owed to TestFit), then TestFit may – in its sole discretion, and without further notice to Customer – either (i) repeat its attempts to collect such Fees and Other Charges using such payment method(s), or (ii) terminate or suspend Customer’s access to the Self-Service Products (and/or any other TestFit products and/or services), in addition to any other rights or remedies TestFit may have under the Agreement. Termination or suspension by TestFit shall not relieve Customer of its obligation to pay applicable Fees and Other Charges accrued prior to such termination or suspension.
Customer is responsible for maintaining current, complete, and valid payment information on file; TestFit may periodically authorize Customer’s payment method in anticipation of applicable fees or related charges.
Cancellation Policy
All sales are final. Once Customer has completed the self-service checkout process to purchase any Self-Service Product, TestFit will automatically charge all applicable Fees and Other Charges owed in respect of the Order Term to the payment method(s) provided by Customer to TestFit.
Any request for cancellation delivered by Customer to TestFit at anytime after Customer’s completion of the self-service checkout process will be processed as a notice of non-renewal (effective as of the expiration of the then-current Order Term or Renewal Term) to the extent such request complies with the requirements for notices of non-renewal set forth in the “Monthly Subscription” section of these Self-Service Terms.
